Governor Ritter recently signed House Bill 1091 which will require most homes in the state to install Carbon Monoxide detectors. The Bill, known as the Lofgren and Johnson Families Carbon Monoxide Safety Act received a great deal of public support following the deaths of the Lofgren family of four during an Aspen ski vacation, and Lauren Johnson, a 23 year old grad student at the University of Denver.
Any residential property with a fuel burning appliance, any kind of fireplace, or an attached garage will be required to equip CO detectors within 15 feet of any bedroom if the property is going to transfer hands on or after July 1, 2009. This includes the selling, leasing, or trading of such a property.
Some highlights:
1. Residential property equipped with a fuel-fired heater, appliance, fireplace or an attached garage will be responsible for the proper installation of a CO detector.
2. CO detectors will be required within 15 feet of the entrance of each room lawfully used for sleeping.
3. There will be no liability against claim if the CO alarm is installed pursuant the manufacturers instructions.
4. This is effective July 1, 2009 for all new rental periods and residential sales.
